There are certain differences in the functional use of the goods designated by the two parties, the content characteristics of the services, etc., and they do not belong to similar goods or services.
Therefore, the trademarks of the two parties do not constitute similar trademarks used on similar goods or services. The opponent also cited previously registered trademarks such as No. 28432227 “Douyin” and No. 27829710 “Douyin” to be used in services such as Class 36 “Insurance Information; Stock and Bond Brokerage”. The trademarks of the two parties have certain differences in terms of word composition and call and do not constitute similar trademarks. Therefore, the trademarks of the two parties do not constitute similar trademarks that can be used for similar services, and the registration and use of the opposed trademark will generally not cause confusion among consumers. Finally, the State Intellectual Property Office registered the No. 54285649 "Donkey Shaking" commercial standard.
In September this year, the trademark "Shaking Donkey" applied by Beijing-Hangzhou (Wenzhou) Technology Co., Ltd. was approved for registration.
